Agreement to Terms

By downloading, installing, or using the Sona mobile application ("App") or accessing this website, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, do not use our services.

Description of Service

Sona is a social music discovery application that allows users to identify songs playing in their environment, save discoveries with location context, and share their musical experiences with other users. The App uses audio recognition technology to identify songs and location services to tag discoveries with venue and geographic information.

Eligibility

You must be at least 13 years of age to use Sona. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the service.

Account Registration

To use Sona, you must create an account using Sign in with Apple or another supported authentication method. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information and to keep your profile information current.

User Content

You retain ownership of content you create within Sona, including notes, profile information, and discovery metadata. By posting content on Sona, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content in connection with operating the service.

You agree not to post content that:

• Is unlawful, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains spam or unauthorized advertising
• Impersonates another person or entity
• Violates the privacy of others

Audio Recognition

Sona uses Apple's ShazamKit and other services to identify songs. Audio recognition is not guaranteed to be accurate or available at all times. We are not responsible for incorrect identifications or service interruptions in audio recognition.

Location Services

Sona uses location services to associate discoveries with venues and geographic locations. Location features are optional — you may use the app without granting location permissions, though some features will be limited. Location data is handled in accordance with our Privacy Policy.

Intellectual Property

The Sona name, logo, app design, and all associated branding are the property of Sona and are protected by copyright and trademark laws. Song metadata, album artwork, and streaming links are the property of their respective rights holders and are displayed under applicable licenses and fair use provisions.

Acceptable Use

When using Sona, you agree not to:

• Use the service for any unlawful purpose
• Attempt to reverse engineer or decompile the App
• Use automated systems or bots to interact with the service
• Interfere with or disrupt the service's infrastructure
• Create multiple accounts for deceptive purposes
• Harass, bully, or intimidate other users

Account Termination

You may delete your account at any time from within the App settings. We reserve the right to suspend or terminate accounts that violate these terms. Upon deletion, your profile, discoveries, and associated data will be permanently removed.

No Warranties

Sona is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be available at all times, error-free, or that audio recognition will always be accurate. We make no promises regarding the availability or quality of third-party streaming links.

Limitation of Liability

To the fullest extent permitted by law, Sona shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or damages resulting from service interruptions.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. We will notify users of material changes through the App or via email. Your continued use of Sona after changes constitutes acceptance of the updated terms.

Copyright and DMCA

We respect the intellectual property rights of others. If you believe that content on Sona infringes your copyright, please send a written notice to mark@sonafm.com including:

• A description of the copyrighted work you believe has been infringed
• The location of the infringing content within the App
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid DMCA notices promptly and may remove or disable access to the allegedly infringing content.

Dispute Resolution

If you have a dispute with Sona, we encourage you to contact us at mark@sonafm.com so we can attempt to resolve it informally.

Any dispute that cannot be resolved informally shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action. You may opt out of this arbitration clause by sending written notice to mark@sonafm.com within 30 days of creating your account.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
